PRIVACY POLICY FOR THE PROCESSING OF PERSONAL DATA

(within the meaning of Regulation (EU) no. 679/2016 - on the protection of individuals with regard to the processing of personal data and on the free movement of such data)

The society Dinamitek S.R.L. with headquarters in Via Genova, 9–12100 Cuneo (CN), Vat Number IT03260550045 in its quality of data controller, pursuant to art. 13 of Regulation (EU) no. 679/2016 - on the protection of individuals with regard to the processing of personal data and on the free movement of such data, wishes to inform you that your personal data will be processed in the following manner and for the following purposes:

The object of the treatment and the source of the data

The data controller processes the personal data, identification data (e.g. name, surname, company name, address, phone, e-mail, bank details and payment) provided by the interested party on the occasion of:

  • visits or phone calls;
  • interactions through the internet site;
  • previous contractual relationships.

The purposes of the processing

The data will be processed in full respect of the principles of confidentiality, fairness, legality and transparency, including through the use of electronic and/or automated means and the processing will have the following purposes:

  • allow the User registration to the website;
  • allow Users to post material and any other information (hereafter, the “Contributions”) directly on the Site, or on sites operated independently by third parties with which Dinamitek s.r.l. has possibly reached agreements in this sense, such as, but not limited to, social networks such as Facebook, Twitter, etc., (hereinafter the “Social Network”);
  • administrative / accounting activities, strictly related and instrumental to the fiscal and bureaucratic and organizational management of the requested services;
  • commercial management of business;
  • management of customers and suppliers;
  • the supply of goods and services and for the protection of credit positions deriving from them;
  • performing marketing activities such as sending promotional and advertising material of Dinamitek s.r.l., by e-mail, mms and sms;
  • carrying out analysis about the habits or consumption choices, and the definition of the profile of the Users through the use of information provided by the latter at the time of registration, or on the occasion of the completion of questionnaires or on the basis of actions performed or information provided during the Site navigation;
  • respond to User requests in relation to products Dinamitek s.r.l., advertising, or Website (section “Contact”);

Legal basis

The legal basis is constituted by the execution of a contract to which the data subject is party or in the execution of pre-contractual measures taken at the request of the same. Some treatments are carried out for the legitimate interest of the Holder (promotion of commercial activity and the pursuit of the statutory purposes).

With regard to the newsletter, the personal information of individuals that subscribe to the same are lawfully processed to send by e-mail the newsletter and to allow them to let the sending cease, or to unsubscribe from the list of recipients.

The personal data of natural persons who fill out the “Contact us” form are lawfully treated to deal with the demands posed by the person concerned.

Communication of the data

The personal data processed by the data controller shall not be disclosed or will not be given to unidentified entities, in any possible form, including their provision or simple consultation.

They can, however, be communicated to the workers employed by the controller and to some external subjects who collaborate with them. In particular, on the basis of the roles and work tasks, some workers have been entitled to treat the personal data, within the limits of their competence and in accordance with the instructions thereto issued by the controller. They may also be communicated, within the limits strictly necessary, to those subjects that for purposes of the issuance of our orders, requests for information and quotations have to provide goods and/or perform services on our behalf. Finally, it may be communicated to the subjects entitled to access them by virtue of the provisions of law, regulations, community legislation for the purposes of consulting services on tax law and labor law.

Finally, the data may be communicated to third parties belonging to the following categories:

  • entities that provide services for the management of the informative system used;
  • professionals, studies or companies within relationships of assistance and advice on tax and labor law;
  • factoring companies;
  • credit insurance companies;
  • marketing companies;
  • credit institutions;
  • companies operating in the transport sector;
  • competent authorities for the fulfilment of legal obligations and/or provisions of public bodies, on request.

Data transfer

The controller will not transfer the personal data to third countries or to international organisations. However, the company reserves the possibility to use services in the cloud; in which case, the suppliers of services will be selected from among those that provide adequate guarantees, as provided for by art. 46 GDPR 679/16.

Mode of processing and storage of data

The treatment will be carried out in automated and/or manual way, with methods and tools aimed at guaranteeing maximum security and confidentiality, by parties engaged specifically for this purpose in accordance with art. 4 and from the principle of accountability of the G. D. P. R.

The data controller retains and processes personal data for the time necessary to fulfill the purposes indicated. Subsequently, the personal data will be preserved, and not further processed, for the time established by the current provisions on civil and tax legislation.

Rights of the interested party

Under the GDPR 679/2016 the data subject has the right of access (art. 15), on the basis of which he or she can obtain a copy of the personal data; right to rectification (art. 16); the right to erasure (art. 17), on the basis of which he or she can request the cancellation of their data by the data controller to which they were provided and by the other data controllers involved in the scope of dissemination of data; right to restriction of processing (art. 18), for which the data subject may exercise the right to object, in whole or in part, to treatment, to obtain one or more adjustments of their own data, and request in the expectation of feedback, the locking of the latter; and the right to portability (art. 20); the right to object (art. 21); and the right to object to automated decision-making process (art. 22).

The data subject in order to assert their rights can contact the data controller by specifying the object of their request, the law that it intends to exercise, and enclosing a photocopy of an identity document attesting to the legitimacy of the request to the following address:

Revocation of consent

With reference to art. 6 of the GDPR 679/16, the data subject may at any time revoke consent any related.

The proposition of the complaint

The data subject has the right to lodge a complaint to the supervisory authority of the state of residence.

The nature and mode of conferment of personal data of users

The conferment of Personal Data may take place:

a) by filling the appropriate fields in the various sections of the Site;

b) with the automatic filling, thanks to the User request to a Social Network to which he or she is subscribed to communicate to Dinamitek s.r.l. some of the data that the User has already given to the Social Network. In this case, by selecting the link that allows registration through a Social Network present on the Site or on one of the pages of Dinamitek s.r.l. present on the Social Network, the user will be prompted to:

- read the present disclosure;

- declare to be of age;

- specify which data, among those that are mandatory and optional, he or she consents that are to be transmitted from the Social Network

c) automatically by computer systems. The computer systems and software procedures for the operation of the Site offer and/or acquire automatically and, indirectly, certain information that may constitute personal data, whose transmission is implicit in the use of Internet communication protocols (such as, for example, but not limited to, the “cookies” -as better specified below- “IP” addresses, domain names of computers used by users who connect to the Site, the addresses in “Url” notation of the resources requested, the time of the request to the server).

Refusal to provide data

The data subject may not refuse to give to the controller the data necessary to comply with the provisions of the law governing commercial transactions and taxation; furthermore, the provision is mandatory for all of the information contained in the fields marked by an asterisk, so that Dinamitek s.r.l. can execute the order of the User in respect of the obligations of the law. The failure, partial or incorrect conferment of personal data marked by an asterisk will result in the inability to provide the requested service. The provision of all other personal data is optional.

It follows that the failure, partial or incorrect conferment of such optional personal data will not result in any consequence.

Automated decision processes

The controller carries out on personal data processing consisting in automated decision processes.

Use of cookies and similar technologies

What are cookies

Cookies are text strings of small sizes that the sites visited by the user send to his terminal (usually the browser), where they are stored to then be retransmitted to the same sites at the next visit of the same user.

The purpose of the cookies

Cookies usually present in the browser of users in very large numbers, and sometimes also with features of wide persistence of time, are used for different purposes: execution of authentication information technology, monitoring of sessions and storing information on the specific configurations about users accessing the server, etc

Cookies duration

Some cookies (session cookies) remain active only until you close your browser.

Other cookies "survive" the closing of the browser and are also available in the subsequent visits of the user. These cookies are called persistent, and their duration is set by the server at the time of their creation. In some cases, a deadline is set, in other cases the duration is unlimited.

Types of cookies

In consideration of the duration:

a) session cookies are removed when the user closes the browser and have a duration limited to the visit;

b) permanent cookies: remain in the device used to browse the Internet for a determined period of time. These cookies have typical expiration dates and, therefore, their duration varies depending on the cookies used.

In consideration of the purpose:

a) technical cookies: those that are used only for the purpose of "carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide the service" (cf. art. 122, paragraph 1, of the Code).

They are not used for further purposes and are normally installed directly by the owner or operator of the web site.

The following cookies belong to this category:

(i) navigation or session cookies, which guarantee the normal navigation and use of the website (allowing, for example, to make a purchase or to authenticate to access the reserved areas).

Disabling these cookies may adversely affect the performance of the sites and cause unavailable functionality, and service.

(ii) performance cookies, which collect information on the efficiency of the responses of the web Site to the needs of users in an anonymous form, solely to improve the functionality of the Website; for example, what pages are most frequently visited by the user, and if there were any errors or delays in the delivery of web pages.

(iii) functionality cookies, which allow the user the navigation according to a set of selected criteria (for example, language, products selected for purchase) in order to improve the service rendered to the same.

Analytics cookies can be considered technical cookies when used directly by the site operator to collect information, in aggregate form, on the number of users and on how they visit the site.

b) cookie profiling are aimed at creating profiles related to the user and are used to send advertising messages in line with the preferences expressed by the same in the context of the navigation in the network. The following cookies belong to this category:

(i) cookies for targeted advertising or “targeting cookies”, which are used to offer users advertising potentially close to their interests, as well as detected during the navigation. They are for example used to limit the dose of a given advertisement, or to infer the effectiveness of a campaign by the frequency of display of advertising. These cookies can also be administered by a third parties, also on behalf of advertisers. The User can accept or refuse these cookies by expressing their consent (“opt in”) prior to the administration of the same.

Third-party cookies

In the course of navigation on a site, the User can receive on its terminal cookies that are sent from different sites or web servers ("third parties").

By way of example, there may be cookies linked to services provided by Google Analytics or cookies due to the presence of a "social plugin" (for example, Facebook, Twitter, Google+ and LinkedIn), generally aimed at the sharing of content.

This Site uses:

- technical cookies: in particular, session cookies (e.g. JSESSIONID, PHPSESSIONID, ASPSESSIONID, Flash Cookies, etc) that are deleted when the browser closes, in order to offer certain services, such as, for example, authentication to restricted areas or selection of products in the shopping cart for purchase.

How to disable cookies

The user can decide whether or not to accept cookies. For this purpose, he or she can use the settings of the Internet browser. Most browsers allow to manage (view, enable, disable and delete) the cookies via the settings.

The rules on the protection of personal data require that the user can disable cookies already administered (“opt-out”). The opt-out is scheduled for the “technical cookies” (art. 122 of the Code), as well as for cookies that do not fall within the “technical cookies” previously accepted by the user (“opt in”).
